HC sets aside extension to top cops

In a major setback to Maharashtra’s director general of police PS Pasricha and Mumbai police commissioner DN Jadhav, the Bombay High Court on Friday quashed 3-month extension of service granted to them by the state government.

MUMBAI: In a major setback to Maharashtra���s director general of police PS Pasricha and Mumbai police commissioner DN Jadhav, the Bombay High Court on Friday quashed 3-month extension of service granted to them by the state government.

The court, hearing a petition filed by RR Tripathi and Gaurang Damani which challenged the extension granted to the top cops, stated that the decision to extend their service beyond their due retirement was arbitrary.

Quashing the government decision, a division bench of chief justice Swatanter Kumar and IP Deodhar stayed its order for three weeks to grant time to file an appeal. The court stated that the government failed to make out its case that extension was granted in larger public interest.

Mr Pasricha and Mr Jadhav were due for retirement on November 30 last year, but got extension which was subsequently challenged. The state government had justified its decision on the ground that the extension was granted by the central government on the state���s recommendation.
