HC sentences Alister Pereira to 3 years’ RI

MUMBAI: Alister Pereira was on Thursday sentenced to three years’ rigorous imprisonment by the Bombay High Court for running over seven persons in 2006. This enhances the six-month sentence handed by the lower court that led to a public outcry and an appeal against it by the state.
Businessman Pereira’s car had run over seven construction workers and injured eight others on the night of November 12, 2006 in Mumbai. He was given a six-month prison term in the hit-and-run case by the lower court under section 304 (a) (causing death by negligence) and Rs 5 lakh on April 13 this year by a sessions court. The judgement had sparked a public outcry and protests that led the state to appeal against it in the High Court.
The division bench of Chief Justice Swatanter Kumar and Justice Ranjana Desai lengthened his sentence to three years under section 304 (ii) (if the act is done with the knowledge that it is likely to cause death, but without any intention to cause death, or to cause such bodily injury as is likely to cause death). The High Court has directed him to pay a fine of Rs 5 lakh.
“He doesn’t deserve any sympathy,” the judges said while Pereira stood in court and added that his bail application will be heard this afternoon.
