HC rejects plea for inquiry against Chattarpur temple trustees
The Delhi High Court has turned down a plea filed by former trustees of Chattarpur temple seeking fresh investigation into alleged misappropriation of the temple's property by the governing body.
A bench headed by Justice T S Thakur also refused to direct the Centre to bring a law for running the temple on the lines of the Vaishno Devi Trust.
"It is the government's discretion and we cannot direct the Centre to pass a legislation for this," the Bench said while accepting Justice K Ramamoorthy (Retd) committee report which had given a clean chit to the present governing body of the temple.
"The report is completely based on evidence and we cannot verify the evidence," the court said.
The Court, in 2004, had appointed a one-member committee headed by Justice Ramamoorthy to conduct an inquiry against the Trust.
The report was submitted in October 2006 in which a slew of recommendations with regard to the Trust were made but the governing body was given a clean chit over allegations of corruption.
Unsatisfied with the finding of the committee, some former trustees approached the court seeking direction to the government to conduct a fresh inquiry against the present trustees. They alleged that they were involved in financial mismanagement and corruption in the Trust.
Challenging the findings of the committee, they had pointed out that the report of a chartered accountant who went into the accounts of the Trust found misappropriation of funds done by members of the governing body which was not taken into account by Justice Ramamoorthy.
