KOLKATA: A division bench of Calcutta High Court on Thursday upheld an earlier order rejecting the caveatable interest of three members of Birla family in the probate petition of Rajinder S Lodha in the Priyamvada Birla estate case.

The bench comprising Justice P C Ghose and Justice T K Dutt rejected the appeal of K K Birla, B K Birla and Yashovardhan Birla challenging the order of a single judge bench.

The bench also rejected Lodha's appeal challenging the caveatable interest of G P Birla, which had been upheld by the lower court earlier.

Birla family is engaged in a bitter legal battle with Lodha for control of the Rs 5,000 crore worth assets of M P Birla group.

Lodha, a chartered accountant, declared more than two years ago that the entire estate has been bequeathed to him by Priyamvada Birla, who died in July 2004 leaving behind no heir.
