ALLAHABAD: Expressing deep concern over acquisition of land "without following the procedure prescribed by law" in Uttar Pradesh, the Allahabad High Court today directed state authorities to ensure that no property was acquired in violation of rules and regulations.

A Division Bench comprising Justices V M Sahai and R N Mishra, which allowed a writ petition filed by Ram Nayan Singh and others, said acquisition of land, even if for public purpose, must be in accordance with "procedure prescribed by law" and the aggrieved parties compensated "in a way that is mutually acceptable and also in accordance with the land acquisition act".

The petitioners had moved the court alleging that their land had been acquired by the state Public Works Department for building a highway connecting Azamgarh and Varanasi without following the due procedure and giving them adequate compensation.

Noting that acquisition of land without following the procedure prescribed by law was "a clear violation of Article 300 A of the Constitution (persons not to be deprived of property save by authority of law), the court directed that copies of the order be sent to the Chief Secretary and all the district collectors.
