Asking the investigating agency to file its response on Thungan's plea for quashing of the charges, Justice Sanjay Kishan Kaul posted the case to May 19.
On November 28, 2007 a city court had framed charges under IPC and the Prevention of Corruption Act against Thungan and three others for allegedly misappropriating Rs two crore, committing forgery and involvement in corruption.
The CBI alleged that Thungan, former union minister of state for Water Resources, had connived with a few officials of irrigation and flood control department of Nagaland in placing a bogus order for buying sausage wire for a project during 1993-94.
No wire was supplied to the department. However, payments were made against bogus delivery, the CBI said.
Besides Thungan, charges were framed against contractors Tali AO, C Sangit and businessman Mahesh Maheshwari.
The order for supplying wire was given to Tali, who produced a bogus bill of Rs 30 lakh and got a demand draft issued in favour of a non-existing person, Thanu Thungan, a name assumed by Maheshwari, the CBI alleged.
The money was divided among all the accused, including Thungan, who received it a bank account opened under the name of Prem Kumar, according to the agency.
A case was registered in 2002 against the four under various provisions of IPC and the Prevention of Corruption Act.
