Extension to top cops challenged in Bombay HC
The three-month extension granted to Maharashtra DGP PS Pasricha and Mumbai Police Commissioner DN Jadhav has been challenged in the Bombay High Court by two city-based social activists.
The PIL, filed by Gaurang Damani and RR Tripathi, contends that the extension to the two top police officers has had “demoralising and debiliating effect” on the state police machinery, and it violates the law. Petitioners’ lawyer said it might come up for hearing later this week.
Mr Pasricha and Mr Jadhav were due to retire on November 30, but Union home ministry granted them extension on the state government’s recommendation. Sources in Union home ministry had said earlier that some senior bureaucrats in the ministry were opposed to Mr Pasricha’s extension.
The PIL says that extension violates All India Services (Death-cum-Retirement Benefits) Rules, 1958, which prescribes sixty as retirement age. The exception is made in case the person is engaged in budgetary work or working on a committee, or if he/she is of outstanding merit. Both Mr Pasricha and Mr Jadhav do not satisfy these conditions, the PIL says.
