ECs must have same stature as SC judge, says Fali S Nariman

NEW DELHI: Eminent jurist Fali S Nariman on Wednesday stated that the Chief Election Commissioner and the two Election Commissioners should be treated equally and have the same stature as a Supreme Court Judge.

The NDA government has moved an amendment to existing legislation that is seen as lowering the status of the EC senior brass and removing their parity with the Supreme Court Judge. The Bill is said to have been pulled back for a review after several former CECs expressed major concerns.

Speaking at the launch of former CEC SY Quraishi's book 'India's Experiments with Democracy,' Nariman stated that there was a slip on the part of those who drafted the Constitution in this regard, but that Parliament should have pass alaw to correct the situation.


Nariman also observed there is a widespread feeling that much more is required to ensure that EC is ‘far more independent than it appears to be’.
