Deface public property and pay Rs 10k
Defacing public property by pasting posters or banners may invite a fine of Rs 10,000.
Appearing for the Central government, Counsel P P Malhotra told a division bench of Justice T S Thakur and Justice Veena Birbal that the government was considering a proposal to enhance the jail term for defacement of public property from six month to one year.
The fine for the offence may also be raised from the existing Rs one thousand to Rs 10,000 as part of the proposed review, he said.
The government would amend the West Bengal Provisions of Defacement of Properties Act, Malhotra submitted adding that the state government has already approved the proposition.
The Bench asked the Centre to inform it within six weeks that when the amendment in the Act will be brought about by the government.
The court was hearing a PIL, filed by former Delhi University Students Union president Monica Kakkar Arora, seeking direction to civic agencies for removal of posters, banners and hoardings put up by candidates and political parties during the student union polls as these led to defacement of public properties.
Arora alleged that police has failed to take action against the offenders and sought direction to the MCD to remove posters and banners which were put on some signposts near Delhi University and other parts of the city.
Earlier, the Bench had directed the police to initiate criminal proceedings against those DUSU candidates and the political parties which had put posters on public properties.
