Decks have been cleared for the extradition of Maninder Pal Singh Kohli to Britain to face trial in the rape and murder case of British teenager Hannah Foster as the Supreme Court today refused to stay the order allowing his extradition.

NEW DELHI: Decks have been cleared for the extradition of Maninder Pal Singh Kohli to Britain to face trial in the rape and murder case of British teenager Hannah Foster as the Supreme Court today refused to stay the order allowing his extradition.

The court was not impressed by the last-ditch effort of his counsel Rajesh Srivastava that Kohli would not get a fair trial in United Kingdom as there was a bias against the Asian communities.

The counsel also mentioned the case of Indian doctor Mohammed Haneef, who has been charged with recklessly supporting a terror group in Australia.

However, a Bench comprising Justices G P Mathur and P K Balasubramanyan, said Kohli's case was of "henious offence".

Kohli had challenged the order of the magistrate and the Delhi High Court allowing the plea of Ministry of External Affairs to extradite him to face the trial in a court at Southampton in Britain.

The repeated pleas by his counsel that the extradition order was erroneous failed to yield any result as the Bench said the accused can approach the High Court for its review.

Kohli had contended the original evidence placed before the Extradition Magistrate had not supported the allegations against him and the order for extradition was passed after considering additional evidence which were placed before the court at later stage.

The counsel contended that the Magistrate instead of considering the prime facie evidence for the purpose of extradition took into account the entire evidence.

"It was almost like a trial and only sentence was not pronounced," Srivastava said.
