PATNA: Considering the ‘uncertain’ stay of controversial RJD MP Mohammad Shahabuddin at the All India Institute of Medical Sciences, the Patna High Court on Wednesday fixed October 9 as the deadline for surgery of his spine if the situation permitted or the MP is returned to Siwan jail.
After perusing the medical report of a medical board constituted by AIIMS to examine the MP, Justice V N Sinha ordered the authorities of the premier hospital to conduct the surgery on or before October 9.
The court fixed October 10 as the next date of hearing. The medical report of the Aiims board, which had examined the MP on September 6, said Shahabuddin was not responding to conservative treatment and recommended surgery.
The report, prepared on September 9 and reached the court on September 12, said surgery could not be conducted so far as Shahabuddin had developed respiratory problems.
On the prayer of Shahabuddin’s counsel Y V Giri that the MP’s wife or someone else should be allowed to stay with his client as personal attendant during the operation and recovery period, Justice Sinha said on humanitarian grounds the MP’s wife could do so after the operation if the jail manual permitted.
The new proposal sent by the ‘Sahara Samay’ has asked for Rs 2 lakh for every three hours and considering all aspects the expense would come to Rs 80 lakh per month.
The state was studying a few other proposals and would make suitable arrangements as directed by the court, he said.
The state government, he said, did not discriminate between persons and everybody was equal before the law.
Justice Sinha orally observed that he had also heard chief minister Nitish Kumar saying the same in his speech on August 15 and appreciated his views.
