Court asks insurance firm to pay compensation

The court asked the insurance company to pay the compensation to the kin of the deceased, Rani and Kajal, residing in Rohini, as their parents were no more.

NEW DELHI: Eleven years after an accident claimed the life of two children, a city court has asked an insurance company to pay Rs 2.75 lakh as compensation to the next of kin.
The court has directed the National Insurance Company, under which the truck involved in the accident was insured, to pay the amount with four per cent interest from the date of the accident to the two sisters of the victims without any delay.
Shyam Singh (8) and his sister Bimla Devi (9) were killed when a truck hit them in Rohini in North Delhi here on December 2, 1996.
The court asked the insurance company to pay the compensation to the kin of the deceased, Rani and Kajal, residing in Rohini, as their parents were no more.
"Considering the facts, circumstances and the condition of the victim's family in mind, National Insurance Company Ltd is hereby directed to pay the awarded compensation of Rs 2.75 lakh with an interest of four per cent per annum from the date of incident immediately without any delay," Special Judge Pratibha Rani said.
The court said of the total amount, Rs 55,000 will be released to the two sisters, who were eight and five years old when the accident occurred, and Rs 85,000 each will be kept in any nationalized bank as fixed deposit till they attain the age of 21 years.
The parents of the children had sought a compensation of Rs eight lakh, citing the death of their "only male child" and a daughter. However, both had died during the trial.
"The evidence on record is sufficient enough to establish not only the involvement of the vehicle in the accident but also the fact that the children died due to the driver's rash and negligent driving," the judge said in her order.
