Court allows pre-summoning evidence against Kejriwal & others

A Delhi court has allowed a youth to lead pre-summoning evidence in support of his complaint against activists Arvind Kejriwal, Prashant Bhushan and yoga guru Ramdev .

NEW DELHI: A Delhi court has allowed a youth to lead pre-summoning evidence in support of his complaint against activists Arvind Kejriwal, Prashant Bhushan and yoga guru Ramdev for making allegedly objectionable remarks against Members of Parliament and supporting plebiscite in Jammu and Kashmir.

Metropolitan Magistrate Purshotam Pathak allowed Vibhor Anand, a law student, to lead pre-summoning evidence in support of his allegations while dismissing his plea seeking registration of FIR for the offence of sedition against Bhushan, Ramdev and Kejriwal.

"The application for seeking a direction to produce the accused before the court and the application for seeking a direction to seize the entire objectionable material/evidence against the accused, is dismissed. The present application under section 156(3) CrPC (for directions for registration of FIR) is treated as a complaint under section 200 CrPC (examination of complainant).

"The complainant is granted liberty to lead pre summoning evidence. Put up for pre summoning evidence," the MM ordered.
