NEW DELHI: The Central Information Commission has directed the Law Ministry to provide a copy of the file relating to the appointment of Justice Vijender Jain as Chief Justice of Punjab and Haryana High Court to a man who demanded it under Right to Information Act.
Chief Information Commissioner Wajahat Habibullah, however, asked the Public Information Officer of the Ministry to invite third parties to make submissions in writing about the disclosure and exclude objectionable portion from the information disclosed, if objections are found valid.
Habibullah, in his order, held that the information sought for did not fall under any exclusions specified in the RTI Act.
The order came on the application moved by one Subhash Chander Agarwal seeking copies of the file, inlcuding file notings and the correspondence between the President and Prime Minister in this regard, to the recent appointment of Justice Jain as the Chief Justice of Punjab and Haryana High Court.
Agarwal had applied on November 25, 2006 to the Chief Public Information Officer of President's Secretariat for the information. The latter advised him to take up the matter with the Law Ministry for copies of file and turned down the request for copies of correspondence between the President and Prime Minister.
Observing that the file was now in the custody of the Department of Justice in the Law Ministry, the Commission directed it to provide the files to the petitioner.
