NEW DELHI: A stringent mechanism has been put in place to make telephone service providers more accountable on the issue of phone tapping, the Centre informed the Supreme Court on Friday.

The amended Indian Telegraph Rules, 2007, has been enforced on service providers after the apex court directed the Centre to formulate guidelines following a political controversy involving the tapping of SP leader Amar Singh’s telephone by certain private individuals.

“The service providers are responsible for the actions of their employees. In case of established violations of licence conditions pertaining to maintaining the secrecy and confidentiality of information and unauthorised interception of communication, action shall be taken against the service providers as per Sections 20, 20A, 23 and 24 of the Act. This shall include not only fines but also suspension or revocation of their licences,” said the new rule of the ministry of Communications and Information Technology.

Service providers shall designate two senior executives of the company in every licensed service area/state/UT as the nodal officers to receive and handle such requisitions for interception. "The designated nodal officers... shall, every 15 days, forward a list of interception authorisations received in the preceding fortnight to the nodal officers."
