Centre disposes but HC proposes CBI probe
In a setback to the Samajwadi Party, the Allahabad High Court on Thursday ordered a CBI inquiry into the police recruitment scam that took place during the Mulayam Singh Yadav regime in Uttar Pradesh.
The Allahabad high court order marks a vindication of the stand taken by the Mayawati government, and a snub to the UPA government. Its certain to add to the BSPs ammunition against Mr Mulayam Singh Yadav and his associates ahead of the general election.
In a move that was seen as one of the first indications of the SP and the Congress sinking their differences, the Centre had few months back, rejected the recommendation of the Mayawati government to initiate a CBI inquiry into the scam, in which more than 20,000 candidates were recruited to the post of constables, bending various norms and regulations.
The scam, which occurred in 2005 during the regime of Mulayam Singh Yadav, had attracted allegations of bribery and also caste favouritism in offering jobs to more than 20,000 youths in the police department.
A division bench of Justices Anjani Kumar and V K Verma, acting on a petition filed by some candidates who found themselves cut off from the recruitment process, ordered that a CBI enquiry be conducted into the whole exercise.
The petitioners had challenged the Centres decision to turn down the request made by the state government for conducting a CBI inquiry into the scam.
The bench observed that since the petitioners were not selected in the recruitment process regarding which there are allegations of malpractice, their locus-standi could not be questioned.
Immediately after coming to power in May last year, the Mayawati government had ordered an inquiry into the alleged scam. A probe instituted by the state governments had found that there were large scale bungling in the recruitment process and money had huge bribes had been paid.
The Mayawati government had subsequently sacked all 20,000 youth recruited through the exercise, youths and also suspended dozens of officers involved in the process. It had later recommended a CBI probe into the incident which was not considered by the Centre.
