Filing an application before the designated court of Sapna Mishra at Ghaziabad, CBI pleaded for Talwar's continuance in judicial custody contending that another polygraph test was required.

The counsel for Talwar, however, opposed the judicial custody saying the agency had not found any substantial evidence to prove his role in the gruesome act.

Talwar was arrested on May 23 by Noida police for allegedly murdering his teenage daughter Aarushi and domestic help Hemraj on the intervening night of June 15-16.
