Calcutta HC grants bail to 40 arrested in Dinhata

The Calcutta High Court on Tuesday granted bail to 40 persons arrested after police firing in which five Forward Bloc activists were killed in West Bengal's Cooch Behar district earlier this month.

KOLKATA: The Calcutta High Court on Tuesday granted bail to 40 persons arrested after police firing in which five Forward Bloc activists were killed in West Bengal's Cooch Behar district earlier this month.

Abu Bakkar Mian and 39 other arrested persons, said to be Forward Bloc supporters, were charged with rioting, attacking policemen and ransacking government property.

Senior counsel Sekhar Bose, moving the bail prayers, submitted before a division bench comprising Justice Amit Talukdar and Justice P S Banerjee that sub-divisional officer of Dinhata had not mentioned the death of five persons in police firing in the FIR that he filed after the deaths had occurred.

Bose claimed that the police had fired to kill the protesters and that all the dead persons were hit above the hip and a few in the head.

He stated that as the FIR did not mention crucial incidents, it amounted to suppression of facts and as such the charges brought against his clients were not tenable.

Opposing the bail prayer, public prosecutor Ashimesh Goswami stated that the Forward Bloc supporters had launched a pre-planned attack on the policemen in a bid to kill them.

He submitted that if the accused were released, they would again create trouble at Dinhata, where five FB supporters died in police firing and a National Volunteer Force man was killed.
