BJP's Hussain moves SC over order for FIR in rape case

BJP leader Shahnawaz Hussain Thursday petitioned the apex court challenging a Delhi High Court order directing registration of an FIR against him in a rape complaint.

The appeal was mentioned on Thursday morning before a bench headed by Chief Justice of India NV Ramana. Seeking urgent listing of the case, the counsel appearing for the BJP leader argued that Hussain's reputation was at stake. The top court agreed to list the matter next week.

Ordering registration of an FIR in a rape complaint lodged by a woman in 2018, the Delhi High Court earlier this week said that the police had a lot to explain for not having registered an FIR against Hussain on the receipt of a complaint sent to the Commissioner of Police which clearly disclosed the commission of a cognizable offence of rape after administration of a stupefying substance.In its order, the High Court recorded that there was a complete reluctance on the part of the police to even register an FIR. The court recorded that there was no perversity in the 2018 trial order directing the registration of the FIR and vacated the interim orders of the court staying its operation.
