The two are facing multiple charges under the Unlawful Activities Prevention Act. Section 43D (4) of the Act bars grant of anticipatory bail. They had earlier been granted interim protection from arrest by th SC court till it heard their appeal against Bombay High Court order denying them such bail.
Today, a bench led by Justice Arun Mishra said “it cannot be said that no prima facie case was made out” against the accused and asked them to surrender in 3 weeks. They were also asked to surrender their passports forthwith to the investigating officer.
Senior advocates Kapil Sibal and Abhishek Manu Singhvi argued for Teltumbde and Navlakha respectively. Sibal argued that there was no material to show that he was member of any unlawful organisation or indulged in any other unlawful activities.
