NEW DELHI: The All Assam Minorities Students’ Union has challenged the legality of an amendment to the Foreigners’ Tribunals which have the final say in determining whether a person staying in Assam is an Indian citizen or not.

An amendment made this year has made the tribunals the final appellate authority over those who have been left out of the National Register of Citizens (NRC) process and would be appealing to these tribunals after their claims are rejected.

AAMSU has claimed that the amendment in 2019 was brought in without any consultation with stakeholders, like itself, in the NRC process. The petition argued that there are big gaps between the citizenship rules and the 2019 amendment.

The procedure set out under the amendment mandates that all appeals against exclusion from the NRC process can only be filed along with a copy of the NRC order.
