Asks J&K to provide security and medical facilities for Amarnath pilgrims

The Supreme Court on Friday refused to quash the order of Jammu and Kashmir government revoking transfer of land to the Amarnathji Shrine Board, a decision which witnessed widespread protests across the country.

NEW DELHI: The Supreme Court on Friday refused to quash the order of Jammu and Kashmir government revoking transfer of land to the Amarnathji Shrine Board, a decision which witnessed widespread protests across the country. The court, however, asked the state government to provide adequate security and medical amenities to the stranded pilgrims in the state.

���We are not cabinet. We cannot revoke a cabinet decision,��� said a bench comprising Justice Altamas Kabir and Justice GS Singhvi. The court rejected the plea made by the chairman of the J&K National Panthers Party, Prof Bhim Singh who submitted before the bench that it has four members in the assembly. He had sought quashing of revocation order of July 1 on the ground that the present government has reduced to a minority status and the governor of the state has already convened the assembly on July 7 asking the chief minister to prove his strength on the floor of the house.


���Till July 7, the present minority government is not competent to issue any substantive order,��� petition had said.
The bench also dismissed another plea which had sought direction to the authorities to withdraw the curfew imposed in Jammu and other areas in the interest of rule of law and democracy.

���We are not going to withdraw curfew. Lifting the curfew is beyond our jurisdiction,��� said Justice Kabir.
The court also disallowed yet another prayer of the petitioner which had sought direction to the government to pay compensation to the families of those killed and injured in police firing during current turmoil.

���It is the government to decide���, said court terming the petition as ���Political Interest Litigation���. The court, however, asked the government to provide adequate security and medical facilities to the stranded pilgrims in the state.

���Pilgrims either to Vaishno Devi or Amarnath Shrine be provided adequate security till they complete their pilgrimage and leave Jammu and Kashmir���, court ordered. The court while asking to provide proper medical facilities to such pilgrims also ordered for extension of such facilities to the people of the curfew-bound areas.
