Arun Jaitley CDR case: Court dismisses police's plea for further police custody

NEW DELHI: A court here today dimissed the plea of Delhi Police seeking further police custody of two of the accused in the case relating to retrieval of BJP leader Arun Jaitley's phone call details, to interrogate them in another related case.

Additional Sessions Judge T S Kashyap rejected the plea of Special Cell of Delhi Police for police custody of co-accused constable Arvind Dabas and private detective Neeraj Nayyar in another FIR registered against them for allegedly buying SIM cards and cellphones on forged documents.

The police had moved the sessions court against the March 13 order of a magisterial court which had refused further police custody of the duo for custodial interrogation.

The Special Cell has claimed it wants to recover SIM cards and some data cards used by Dabas and Nayyar for which it needs to interrogate them.

Anurag's counsel Naushad Ahmad Khan opposed police's plea saying "the fresh FIR is not a new case or any new offence but is an offshoot of the original FIR and the plea for their custody is a gross abuse of criminal justice system."

The Delhi Police had registered a fresh FIR against Neeraj and Dabas and had interrogated the duo in Tihar jail on March 11 and then got their police remand for a day on March 12.

The magisterial court, however, had refused to extend their police custody after which the police moved the Sessions court.
