The couple are now under the Tamil Nadu government's scanner with the state suspecting that surrogacy laws may have been broken by the director-actor duo.
Tamil Nadu Health Minister, Ma Subramanian, during a press conference on Monday evening said that surrogacy law is itself subjected to a lot of debates.
Nayanthara and Vignesh Sivan have been married for all of four months, following a years long relationship. Their eligibility for a surrogate baby is under question, with the rules stating a five-year long marriage as one of the bases for eligibility.
In addition, the rules stipulate that couples above 21 years of age but under 36 are eligible for surrogacy with the consent of their families. Both Nayanthara and Sivan are 37.
The Health Minister said that an inquiry will be conducted and he would instruct the Director of Medical Services to conduct an inquiry.
Commercial surrogacy is banned in India, with the government only allowing couples to pay medical expenses in the event of a surrogate birth.
