Tribunal member R V Mohite directed truck owner Ramakant Kamlakar Rane to pay the compensation to the deceased’s mother and other dependents. The interest will be calculated from the date the compensation petition was filed, according to the report.
The case concerns the death of Akib Anis Attar, who was riding a motorcycle on Ghodbunder Road on February 9, 2016, when a speeding truck allegedly struck his two-wheeler. Attar suffered serious injuries and later died while undergoing treatment at a hospital.

According to the petition, Kasarwadavli police registered a first information report and filed a chargesheet against the truck driver, accusing him of rash and negligent driving under the Indian Penal Code (IPC).
Insurance company, truck owner contested claim
The compensation claim was opposed by Reliance General Insurance Co. Ltd., which argued that the insurance policy submitted in the case was fake and forged. The truck owner, meanwhile, contended that the accident had occurred because of the motorcyclist’s negligence.After examining oral and documentary evidence, the tribunal determined liability in the compensation proceedings.
The tribunal also clarified that an acquittal in a criminal case does not automatically warrant the rejection of a motor accident compensation claim. It noted that criminal proceedings require guilt to be established beyond reasonable doubt, whereas claims under the Motor Vehicles Act are decided on the basis of a preponderance of probabilities.

Compensation covers future income, other losses
The tribunal assessed the total compensation at Rs 23.86 lakh. The amount includes compensation for loss of future income, future prospects, loss of consortium, loss of estate and funeral expenses.The award directs the truck owner to pay the amount with interest at 9% per annum from the date the petition was filed, providing compensation to the deceased motorcyclist’s mother and other dependents.
