Gurgaon Bike accident case: Why this case is being highlighted so much, says man accused of hitting the female biker, claims he didn't know she was a woman

Kalyan Bainsla, the car driver accused of hitting a woman sports bike rider, was arrested from Rajgarh in Rajasthan on Tuesday, Gurugram Police Commissioner Sibash Kabiraj told PTI. The arrest followed Gurugram police adding an attempt-to-murder charge under Section 109 of the Bharatiya Nyaya Sanhita (BNS), which provides for imprisonment of up to 10 years.

Earlier, speaking to India Today, Bainsla denied deliberately ramming his car into the motorcycle and said he was unaware that a woman was riding the bike at the time of the collision.

In an interview with India Today TV, Bainsla said the incident took place on Sunday morning while he was travelling with his cousin. He claimed that two bikers repeatedly overtook his car from the side, moved ahead and then slowed down.


“I did not hit them intentionally,” Bainsla said, while expressing regret over the woman’s injuries. He also questioned why the incident was receiving attention and urged the police to examine the complete video before drawing a conclusion.

‘I did not know there was a girl on the bike’

Bainsla said he was unaware that the rider was a woman when the collision took place.

“I am sorry that a mistake happened. I did not know that there was a girl on it,” he said.

His statement comes after videos recorded by cameras mounted on the bikers’ motorcycles went viral on social media. The woman has alleged that the occupants of the car followed her and that the driver drove aggressively before ramming into her motorcycle.

Bainsla disputed that account and said the viral footage did not show the entire sequence of events.

‘Why is this case being highlighted?’

Bainsla questioned why the incident had received particular attention and asked what made the case different from other road collisions.

He said he had spoken to the DSP and requested that the entire video be examined before a conclusion was reached. Bainsla maintained that the footage circulating online did not provide the complete context of what happened before the collision.

“They were repeatedly coming in front of me and then slowing down the bike,” he said. “Am I going around hitting everyone? You can check the CCTV.”

He also claimed that the bikers turned their motorcycle without looking into the car’s mirror and lost control, resulting in the collision.

“Let’s assume that the collision happened accidentally. I accept that a mistake happened,” Bainsla said.

Bainsla says he thought of stopping after crash

When questioned about why he did not remain at the scene after the collision, Bainsla said he had considered stopping and did stop at a red light.

He said he rolled down the car window at the traffic signal but eventually drove away after people travelling with him insisted that he leave.

The woman’s video released on social media shows one of her fellow bikers confronting Bainsla at the traffic light. The footage shows the rider speaking to him before the sedan drives away.

Bainsla said he had been asking the bikers to ride more slowly rather than attempting to hit them.

“I was also saying in the video that you are riding well, but ride slowly. Don’t keep troubling me repeatedly,” he said.

He reiterated that the complete footage and CCTV footage should be examined to establish the sequence of events.

Police registered FIR after viral videos

The incident prompted Gurugram Police to take suo motu cognisance after videos of the alleged collision circulated online. Police registered an FIR against an unidentified person.

The injured biker has also said she would file an FIR with her lawyer and pursue legal action.

Bainsla’s account differs sharply from the woman’s allegations. She has claimed that the car followed her and was being driven aggressively before swerving into her motorcycle. A fellow biker’s helmet camera also captured events after the collision, including the confrontation at the traffic signal before the sedan drove away.

Bainsla denies deliberately hitting motorcycle

Bainsla said the sequence shown in the viral videos should not be viewed in isolation. He claimed that the bikers repeatedly moved in front of his car and slowed down, and that he was asking them to maintain a slower pace.

He said he was sorry the woman was hurt but maintained that he had not intentionally struck the motorcycle.

Bainsla also said there had never previously been a criminal case against him.

“There has never been a case against me in my name,” he said.

He added that he would respond to allegations if they affected his family, saying he would speak up if claims about the incident were extended to his relatives.
