Hussian had moved court seeking to set aside the direction of the megistrate to register a case citing that a preliminary investigation by the local police had given him a clean chit.
The High Court asked the Police to complete the probe in three months. The court wondered that despite the woman had recorded her statements on four occasions but the FIR was not lodged.
“There seems to be a complete reluctance on the part of police to even register an FIR" the court observed.
After the police report, the magistrate will determine whether to accept it to either proceed with the case, or hold that no case was disclosed and cancel the FIR after granting a hearing to the complaint, the judge explained.
In 2018, a woman from Delhi had moved the lower court seeking registration of an FIR against the BJP leader on her allegation of rape. A magisterial court had on July 7, 2018, ordered registration of an FIR against Hussain, saying a cognizable offence was made out in the complaint of the woman.
