Chit fund didn't pay Rs 15 lakh prize money to the winning member for 55 days; consumer commission orders Rs 44,500 compensation and refund.

A Telangana consumer commission has upheld an order against Kapil Chits after finding that the company delayed payment of a ₹15 lakh chit prize amount by more than 55 days. The amount was due to S. Eashwar, a mobile shop owner from Mahabubnagar who had been declared the successful bidder in a ₹25 lakh chit.

The company argued that the delay was because Eashwar had submitted his required sureties late and that the documents needed to be verified before the prize money could be released. The Telangana State Consumer Commission, however, found that the company's own records showed the sureties had been furnished on March 28, 2019, and concluded that the final payment was delayed by more than 55 days.

Consumer joined Rs 25 lakh chit to expand his mobile business

The complainant, S. Eashwar, a self-employed mobile shop owner from Mahabubnagar, had joined a ₹25 lakh chit operated by Kapil Chits.


The chit began in May 2018, with Eashwar required to pay ₹50,000 every month for 50 months. He wanted to take the prize amount to develop his business.

He participated in the chit bid held on December 15, 2018, and was declared the successful bidder after agreeing to forego ₹10 lakh. This left a prize amount of ₹15 lakh payable to him.

Eashwar then furnished four sureties as required by the chit company. The sureties included three income-tax payers and a head nurse working at a government hospital.

Company said sureties were submitted late

The dispute began over how long Kapil Chits took to release the prize money.

The company claimed Eashwar had furnished the sureties only on April 28, 2019. It argued that the sureties had to be verified before the prize money could be released and said the amount was eventually paid on May 18.

Kapil Chits also claimed that there was only a five-day delay after the verification process and that it had already paid ₹1,100 as interest for that period.

However, the Telangana State Consumer Disputes Redressal Commission found a different date in the company's own records.

According to the Commission, a document produced by Kapil Chits showed that Eashwar had actually furnished the sureties on March 28, 2019, rather than April 28 as claimed by the company.

The Commission also noted that the final payment of ₹13,00,375 was made only on May 25, 2019. In total, the company had paid ₹14,85,000 to him on three different occasions.

Commission finds more than 55-day delay

The Telangana State Consumer Commission said the Chit Fund Act did not prescribe a specific time limit within which a chit fund company had to pay the prize amount after receiving the sureties.

But that did not mean the company could indefinitely delay payment.

The Commission said that even if the company were allowed one week to verify the sureties, it should have paid the prize money by April 1, 2019.

Instead, the last payment was made on May 25.

That meant the payment was delayed by more than 55 days, the Commission observed.

It therefore agreed with the District Consumer Commission that the delay amounted to a deficiency in service.

Rs 1,100 interest found too little

Kapil Chits had argued that it had already paid ₹1,100 as interest for the delay.

The State Commission, however, found that amount inadequate considering the actual period of delay.

It calculated that if interest on the ₹15 lakh prize amount was considered at 12% per annum for two months, it would work out to about ₹30,000.

Against this, the company had paid only ₹1,100.

The Commission therefore upheld the District Commission's decision to award ₹25,000 for the delay.

Rs 17,500 insurance amount also in dispute

Eashwar had also complained that ₹17,500 had been deducted from his chit amount towards an insurance premium without his consent.

Kapil Chits maintained that the amount had been returned to him and relied on documents to support its claim.

The District Commission nevertheless directed the company to refund the ₹17,500 and also awarded ₹25,000 for the delay, along with ₹2,000 towards the costs of the proceedings.

The chit company challenged this order before the Telangana State Consumer Commission.

Consumer commission upholds order

After examining the records, the Telangana State Consumer Commission found no reason to interfere with the District Commission's decision on the delayed payment.

The Commission held that the records supported the finding that the sureties had been furnished on March 28 and that the final payment was made only on May 25.

It consequently upheld the ₹25,000 compensation for the delay and ₹2,000 litigation costs, along with the ₹17,500 refund, taking the total monetary relief to ₹44,500.

The order was passed on August 19, 2026, by the Telangana State Consumer Disputes Redressal Commission, Hyderabad.

For Eashwar, the dispute was not over whether he had won the chit bid. The Commission had already recognised that he was the successful bidder. The issue was how long the chit company could take to release the ₹15 lakh prize amount after he had complied with the requirement of furnishing sureties.
