The 2021 USAA data breach victims have four weeks until April 7 to file their claims for the $3.25 million funds. Eligible customers wanting compensation must perform their claim submission through the designated website within the April 7 deadline.

The eligibility verification process includes two steps

The settlement agreement in December 2024 required the USAA to contact people who suffered from the breach through email or postal mail procedures. Customers need the claimant ID code along with the confirmation code that the notice included, to submit their claim. The letter needs to be retained because it represents an essential requirement for a successful filing procedure.

Those who file their claim after the established deadline will not receive compensation until the settlement administrator finds them individually. Failure to file a claim within the specified deadline discontinues your ability to sue USAA regarding this incident now or in the future.

USAA data breach and the legal battle that followed

USAA allowed unauthorised access to personal data of 22,000 customers, when they suffered a breach attack in May 2021. The use of motor vehicle records by USAA to provide automated personal detail input on insurance quotes triggered the issue. The system vulnerability exposed the personal information of USAA customer Vincent Dolan, so an unidentified person could make an unauthorised account creation in his name.

Dolan took legal action against the company through court after receiving notification explaining the breach, thus beginning a prolonged three-year court process. The second settlement agreement between both parties resulted in a $3.25 million payout during August 2023.

Settlement distribution and USAA’s response to the data breach

Dolan stands as the primary plaintiff in the class-action lawsuit, where he will obtain between $5,000 and $10,000. The legal costs his attorneys can claim amount to $35,000, while their additional fees are restricted to one-third of the settlement fund, maxing out at about $1.08 million.

Claimants might receive extra payments after all valid claims process, if the remaining balance exceeds $5 per individual. Physical check payments issued by the company lack validity after 60 days from their date of issuance.

USAA accepts the settlement terms, though the company maintains that it took no wrong actions. Through a corporate announcement, the company declared its dedication to safeguarding customer data, while they blamed the breach on extensive cyberattacks across the industry during 2021. The company notified all affected customers right away, while offering complimentary identity theft protection services to them when the breach first occurred.
