US Federal Judge says 'Subway' may get sued. But why

A US federal judge has stated that Subway may be sued over its "100% tuna" product claims. The ruling has come after lab test reports showed the presence of other animals' DNA sequences in Subway's tuna products.

The global sandwich chain, Subway, may face legal suit over the claims that it misleads customers by saying that its tuna products are made of "100% tuna," said a federal judge in California on Monday.
According to the legal lawsuit initiated in January 2021 by Oakland-based Nilima Amin, she claimed that the sandwich chain's "100%" tuna products contained other fish and animal products aside from tuna. And the company has been misleading the customers.
In the lawsuit, Amin alleged that about 19 of the 20 samples collected from the sandwich chain's different stores in Southern California had no detectable DNA sequences of tuna. The claim was based on the reports of the DNA barcoding tests conducted by the Barber Lab of the Department of Ecology and Evolutionary Biology at UCLA. The test reports also claimed that all the samples collected and tested had "detectable sequences of chicken DNA." Besides, 11 of the samples had pork DNA, while seven contained cattle DNA.
However, Subway has rubbished the allegations, saying that the fish used in its sandwiches is 100% tuna. Earlier, the company had requested Jon S. Tigar, a US District Court Judge, to dismiss the lawsuit. However, the judge had dismissed only some portions of the legal suit.
Justifying its stand, Subway said that any trace of other animals' DNA was most likely due to the presence of other ingredients, such as mayonnaise and bread, in the sandwiches. However, the judge stated that Subway's explanation could be correct, but it was not a sufficient basis to dismiss the complaint.

The court has given Amin 21 days to file an amended complaint in this matter.
