Supreme Court tariff ruling: In a major setback for US president Donald Trump, the Supreme Court ruled 6-3 that his sweeping global tariffs violated federal law, marking one of the most significant defeats of his second administration.

Supreme Court Tariff Ruling: Why SCOTUS Blocked Trump Tariffs

The decision, written by Chief Justice John Roberts, found that Trump overstepped his authority under the International Emergency Economic Powers Act (IEEPA) when he unilaterally imposed tariffs on countries around the world.

The court concluded that the emergency powers he relied on “fall short” and do not provide the clear congressional authorization required for such broad action, as per a CNN report.


Roberts wrote for the majority that, “The president asserts the extraordinary power to unilaterally impose tariffs of unlimited amount, duration, and scope,” adding, “In light of the breadth, history, and constitutional context of that asserted authority, he must identify clear congressional authorization to exercise it," as quoted by CNN.

Trump Tariffs Supreme Court Clash: What the Tariff Ruling Means

Trump had defended the tariffs as a way to level the playing field, arguing that other countries were charging American exporters excessive fees. However, the court determined that imposing sweeping global tariffs under IEEPA exceeded the president’s constitutional authority, which rests with Congress.

The ruling is considered one of the most consequential losses Trump has faced before the conservative-leaning Supreme Court, which had previously sided with him in emergency rulings related to immigration, the firing of leaders of independent agencies, and deep cuts to government spending.

Three justices, Samuel Alito, Clarence Thomas, and Brett Kavanaugh, dissented.
