OpenAI, a leader in artificial intelligence, has drawn attention for its employee compensation practices, which have become a central point in a lawsuit filed by Elon Musk. Musk’s legal action names OpenAI, Microsoft, and Reid Hoffman, a Microsoft board member and former OpenAI board member, as defendants. He alleges that the two companies are engaging in anticompetitive practices, including offering "lavish compensation" to monopolize the generative AI market.

According to Musk, OpenAI spends $1.5 billion annually on its workforce of 1,500 employees. This includes a median yearly compensation of $534,197, with software engineers earning a median of $810,000, significantly higher than the $257,500 average in San Francisco’s tech hub. Some high-level positions see pay reaching $1.3 million annually.

Musk’s lawsuit also claims OpenAI’s shift from its nonprofit origins to a for-profit model prioritizes commercial interests over its initial mission to develop AI for humanity’s benefit. OpenAI introduced a capped-profit model in 2019 and is moving toward a fully for-profit governance structure.

The legal conflict has evolved over time. Musk first sued OpenAI in March 2024, accusing the company of deviating from its founding agreements by partnering with Microsoft, which has invested nearly $14 billion, including a $10 billion commitment last year.

Musk later dropped the case in June, only to refile in August, intensifying his criticism. He alleges he was "deceived" into cofounding OpenAI and claims the organization’s focus on commercial gain undermines competitors and restricts access to top AI talent.
