Ohio election: See why it is crucial for constitutional amendments and how it may impact abortion rights

The Ohio election, scheduled for Tuesday, may change not only the process of constitutional amendments, but it may also affect abortion rights. Know in detail why this election is significant for the state.

The Ohio election will be held on Tuesday, which may change the way its constitution can be amended. But, more than that, it may put a hurdle in the path of any amendment in the abortion law and many people believe that the main purpose of the Ohio election is to change the process of constitutional amendments so that it is made difficult to change the liberal abortion law, media reports said.

What is "Issue 1"?

In May, Republican legislators passed "Issue 1," a proposition aiming to increase the necessary voter support for future constitutional amendments in Ohio from a simple majority to 60%. A ‘yes’ to the vote means any constitutional amendment will need at least 60% vote in its favor, but a ‘no’ means the current provision of a simple majority for amending the constitution will continue. Since 1920, a constitutional amendment needs a simple majority.

What Republicans May Do?

This is especially significant because the Republican lawmakers approved issue 1 in May and now, it may be a bizarre reversal on their part. Later, a group of rights activists prepared to bring a ballot initiative on abortion, but the GOP members backtracked.

Will Ohio Election Impact Abortion Rights?

The Republicans are less supportive of abortion rights than Democrats and Independents. They are not supposed to vote for a constitutional amendment in favor of abortion rights that is most likely to be moved in November 2023. The vote will ask the electorate if the constitution of the state should guarantee abortion rights to all of its citizens. If issue number 1 is passed, it will be very difficult for the Ohio voters to get the required 60% votes to enshrine the legal rights for abortion in the constitution.

Supreme Court Verdict

Earlier, the Supreme Court overturned the Roe and West verdict last summer and the 2019 law that prevents termination of more than six weeks of pregnancy. An Ohio judge put the law banning termination of more than six weeks of pregnancy on hold in October 2022. He also restored the abortion right up to 22 weeks of pregnancy.

Abortion Rights and Ohio Election

Soon after, Ohio became a destination for abortion patients, and the neighboring states of Indiana, Kentucky and Virginia enacted sweeping laws banning this kind of termination of pregnancy. But the Supreme Court is currently reviewing the verdict of the lower court. If the November ballot initiative fails, the Supreme Court may reinstate the six-week ban.
