A 'Lord of the Rings' fan fiction writer, Demetrious Polychron, is now at the center of a copyright dispute after publishing his own sequel to JRR Tolkien's iconic series.

In 2022, Polychron released 'The Fellowship of the King,' claiming it to be a "pitch-perfect sequel" to 'The Lord of the Rings.' However, his legal troubles began when he attempted to sue the estate of JRR Tolkien and Amazon in April 2023, alleging that the TV series 'The Rings of Power' infringed upon his book's copyright.

A California court swiftly dismissed Polychron's case, stating that his own work infringed on Amazon's prequel released in September 2022. Following this, the Tolkien Estate initiated a separate lawsuit, seeking an injunction to halt further distribution of 'The Fellowship of the King.' The court, on Thursday, ruled in favor of the estate, instructing Polychron to cease distribution and destroy all physical and electronic copies. Additionally, lawyers' fees totaling $134,000 were awarded to the Tolkien estate and Amazon.


Judge Steven V Wilson, in his order, deemed Polychron's lawsuit "frivolous and unreasonably filed," emphasizing that his work entirely relied on characters from 'The Lord of the Rings.' UK solicitor Steven Maier of Maier Blackburn, representing the estate, expressed the significance of the ruling, stating, "This is an important success for the Tolkien Estate, which will not permit unauthorized authors and publishers to monetize JRR Tolkien's much-loved works in this way."

Maier added, "This case involved a serious infringement of The Lord of the Rings copyright, undertaken on a commercial basis, and the estate hopes that the award of a permanent injunction and attorney's fees will be sufficient to dissuade others who may have similar intentions."

It's worth noting that in 2022, Amazon premiered its blockbuster TV series 'The Rings of Power,' set millennia before Tolkien's original trilogy. The second season is anticipated to debut on Amazon Prime Video in 2024, and Warner Bros has confirmed additional 'Lord of the Rings' films in the pipeline for the coming years.
