The accusation surfaced six months after a media outlet published the judgement by Alito, which rejected earlier decisions upholding a constitutional right to abortion.

Earlier this week, a former anti-abortion activist claimed that Justice Alito's wife, Martha-Ann, played a role in revealing the outcome of a Supreme Court case in 2014. On Saturday, Justice Alito refuted this claim.

The Hobby Lobby v. Sebelius Controversy

Media reported Rev. Rob Schenck's comments about a contentious case, Hobby Lobby v. Sebelius, in which the Supreme Court upheld religious business owners' rights to refuse contraceptive coverage.

A media outlet spent months looking for witnesses to support Schenck's assertion that the Hobby Lobby ruling had been leaked. However, it could not track down anyone who had spoken directly with Alito or his wife about the ruling before it was made public at the end of June 2014.


According to the letter Schenck wrote to Chief Justice John Roberts in July, benefactors to Schenck's organisation, "Faith and Action," were dinner guests at the Alitos' home in 2014, where they were informed of the "status" of the Hobby Lobby case.
