Sean “Diddy” Combs faces a critical moment in federal court as Judge Arun Subramanian prepares to sentence the hip-hop mogul for two counts of transportation to engage in prostitution under the Mann Act. While Combs has already served time in custody, the question now is how many additional years, if any, he could face behind bars.

Federal sentencing guidelines place Combs’ advisory prison term between just under six years and just over seven years, according to Judge Subramanian’s comments in court. The guidelines take into account the severity of the offense, prior conduct, and federal sentencing statutes for Mann Act convictions.

What is the Mann Act?



The Mann Act is a federal law that prohibits transporting individuals across state lines for prostitution or any illegal sexual activity. It is designed to combat human trafficking and protect victims from sexual exploitation.

However, prosecutors have urged the court to impose a sentence of more than 11 years, arguing that Combs repeatedly coerced women into sexual encounters, including former girlfriends and male sex workers, over several years. They emphasize that the abuse and manipulation in these cases demand a lengthy term to reflect the seriousness of his conduct and to serve as a deterrent.

Combs' defense attorneys contend that the proposed sentence is disproportionate. They argue that the acts were consensual and did not involve financial gain. They point to instances where defendants received sentences averaging under 7 months, particularly when no profit was involved. The defense has requested a sentence of no more than 14 months, including time already served.

Judge Arun Subramanian has indicated that he does not see a reason to deviate from the sentencing guidelines. However, he also has the discretion to impose a sentence outside this range, taking into account the nature of the offense and the defendant's history. Factors such as acceptance of responsibility, victim impact statements, and the defendant's conduct during incarceration can influence the final decision.

The probation office has suggested a compromise sentence ranging from 70 to 87 months, and earlier today, the judge indicated that he sees no reason to deviate from these guidelines, though the final decision will be announced in court.
