Drake and 21 Savage have reached a settlement with Conde Nast over their use of a fake Vogue magazine cover to promote their 2022 album, ‘Her Loss’. First reported by news site Semafor, the agreement includes a permanent injunction barring the rappers from any use of Conde Nast’s Vogue trademarks.

As per reports, Drake and 21 Savage also agreed to pay an undisclosed amount to the company. In an internal email, obtained by several media outlets including Billboard, Conde Nast general counsel William Bowes said that the company was “glad” to the matter involving the rappers behind them. He also explained why the publishing giant found it essential to file the lawsuit against the rappers. Bowes said that by using the fake Vogue cover, Drake and 21 Savage “leveraged Vogue’s reputation for their own commercial purposes” and led to confusion among the audience who trust the magazine brand as a voice in fashion and culture.

Representatives of both rappers, however, declined to comment. They used the fake magazine cover to promote the November 2022 launch of the album ‘Her Loss’. Moreover, they also released a fake ‘Saturday Night’ performance, created a deep fake interview with Howard Stern, and teased a fake appearance on NPR’s ‘Tiny Desk’ series.

NPR and Stern embraced the rappers’ joke, but Conde Nast sued them over the use of fake Vogue cover for their promotions. The publication filed a lawsuit in Manhattan federal court dated November 7, 2022, calling Drake and 21 Savage’s stunt a “flagrant infringement” of the company’s trademark rights to exploit the “tremendous value” that a feature on Vogue magazine cover carries in the industry. Just days later, a federal judge agreed with Conde Nast and directed the rappers to pull down all references to Vogue covers.
