The next day, on August 29, a representative for Lively strongly denied Kelly's claims. They said, "At no point in this litigation has Ms. Lively served a subpoena on Megyn Kelly.” Kelly's show wasn't subpoenaed, but reports made it clear that Red Seat Ventures, a company that helps content creators like Kelly with marketing and production, did get a subpoena, according to Deadline.


The legal battle started when Lively sued Justin Baldoni in December 2024, saying he sexually harassed her and retaliated against her. Baldoni has said that all of the accusations are false. Bryan Freedman, who is also Kelly's lawyer, says that Baldoni wants to be proven innocent and is looking forward to the trial in March 2026.
