The militia group decided to enter Whitmer's vacation home and abduct her at gunpoint. The militants planned to use a bomb for mass destruction. Prosecutors claimed that the accused planned to detonate the bomb only to restrain law enforcement’s response to the kidnapping. Fox’s attorney, however, refused the claims made by the prosecutors. He mentioned that Fox and Croft did not use explosives.

The punishment for Adam Fox was decided by Richard Jonker, the US District Court judge. The prosecutors demanded a life sentence for the accused. However, Richard ended up putting him behind the bars for 16-long years. The judge also imposed five years of supervised release besides the 16 years imprisonment.

The two other accused put on trial with Adam and Barry were released from all charges in April 2022. Two other members of the group who were found guilty testified for the prosecution at the first trial and at the time of the retrial. Three other accused were convicted in October 2022.
