T-Mobile wins appeal to sell Apple's iPhone exclusively
A court ruled on Tuesday that T-Mobile can sell Apple's much sought-after iPhone exclusively, reversing a lower court's decision that said an unlocked version must be sold in Europe's biggest economy.
The Hamburg District Court said Tuesday that T-Mobile, part of Deutsche Telekom AG, could indeed sell the phone, coupled with a 2-year contract, that could not be used on networks provided by rival wireless companies.
Last month, T-Mobile was sued by rival Vodafone Group PLC over the sale of the phone and a court agreed, issuing an injunction barring T-Mobile from offering the iPhone exclusively with the minimum 24-month contract, and from selling it only with a so-called SIM lock that prevents users from switching the device to any other operator's network.
T-Mobile had appealed that injunction, which led to the new ruling, and the wireless operator unveiled an unlocked version of the phone priced at euro999 ($1,465), more than twice the euro399 ($585) price of a phone sold in combination with a two-year T-Mobile contract.
