Sean Diddy, in his latest attempt to secure bail before Thanksgiving, drew a comparison to President-elect Donald Trump, emphasizing his right to free speech amid accusations of trying to influence his case through an online public relations campaign.

Diddy's attorneys argued that, like Trump, he is a criminal defendant presumed innocent and entitled to criticize the prosecution. Referring to a December decision by the DC Circuit Court of Appeals, the lawyers noted, "Only a significant and imminent threat to the administration of criminal justice will support restricting Mr. Trump's speech." They claimed this standard should also apply to Diddy.

"Accordingly, the Court should apply Trump's heightened standard when considering Mr. Combs' speech here," Diddy’s legal team stated in their filing.


Prosecutors allege obstruction

Diddy, arrested in September on charges of sex trafficking, racketeering, and transportation for engagement in prostitution, has denied all allegations and is set to face trial on May 5, 2025.

Prosecutors argue that Diddy, from jail, orchestrated a public relations campaign to influence his case. They cited instances where he allegedly used family members to post supportive messages, including one on his 55th birthday. According to the prosecution, Diddy also utilized multiple phone accounts of other inmates and third-party patching services to communicate, going beyond a simple PR effort.

Diddy’s lawyers countered these claims, asserting, "Mr. Combs is not required to sit idly by and acquiesce to all of this. He has a right to a fair trial and a constitutional right to speak out on his own behalf."

The birthday post controversy

Reports revealed that Diddy’s legal team had cautioned him against posting anything via his family, but Diddy allegedly insisted, saying, "I don’t care. It’s my birthday."

Prosecutors argued that such actions demonstrated a deliberate attempt to interfere with the investigation and were not comparable to protected free speech.

Prosecutors dismiss Trump comparison

The prosecution rejected the analogy to Donald Trump, calling it baseless. "Trump's judges faced the unique task of balancing the right of a current candidate for the presidency to speak publicly about his charges against the public's right to a fair trial," they argued.

Despite the ongoing legal battles, Diddy’s lawyers continue to defend his actions, maintaining that he deserves the same constitutional protections as any other defendant.
