In New York state, employers pay for these benefits, not workers and no money is taken from your paycheck for this. The New York State Department of Labor (DOL) runs the program.

“Usually you have to have received a prior warning for the same behavior, so you have to know or should’ve known that the job was in jeopardy,” explained lawyer Elizabeth Saylor, the director of the Employment Law unit at the Legal Aid Society.

For example, if you were fired because you had shown up to work late a number of times, that’s a legitimate reason for firing. But, unless your boss had given you a warning that showing up late would result in you being fired, you may still be able to collect unemployment.

Undocumented people and people here without work authorization — including through travel or student visas — cannot receive unemployment.

How can you file for Unemployment Insurance benefits:

You can file for unemployment by going to the Department of Labor website or by calling the Telephone Claim Center at 1-888-209-8124. There is currently no in-person option to file for unemployment.

If you already have an NY.gov ID login — for example from the DMV, or from the state’s healthcare marketplace — make sure you use the same username and password. And beware of creating a duplicate account, experts say. Once you file your claim, you will need to certify your benefits weekly in order to continue receiving payments.

What are the documents you need?

Although you can start your application without all the documents, having them ready will speed up the process. You will need:

Social Security Number.

Driver's license or state ID card.

Full address and phone number.

Alien registration number (if applicable).

Names and addresses of all your employers in the last 18 months.

Federal Employer Identification Number (FEIN).

How much money can you claim?

According to a report in The City, you can claim unemployment for up to 26 weeks, or half of a year. The amount you receive depends on your earnings over the past 18 months. Your highest-earning quarter is divided by 26 to determine your weekly benefit payment. For instance, if you were earning minimum wage, your weekly benefit would be about $304. You can use the online calculator to estimate your exact benefit amount.

The maximum weekly benefit available is $504. According to the Department of Labor’s formula, this is the payout for anyone who earned approximately $52,000 or more in annual salary.

Each week you are unemployed, you must log into the system with your NY.gov ID or call 888-581-5812 to certify that you continue to meet the requirements. This step is mandatory in order to receive the corresponding payments.

When can you receive the benefits?

Generally, the first payment takes between three and six weeks from the time you submit your application. This time is used to review and process your information. If you are eligible, you will receive back payments along with the first deposit.

Applying for unemployment benefits in New York in 2025 is an accessible process if you meet the requirements and submit the proper documentation. Remember that you must keep up your active job search and certify weekly to continue receiving financial support. For more information, visit the official NYS DOL or ACCESS NYC websites.
