Kroger savings club settlement: You may be eligible for payment in $17 million class-action settlement over pricing claims; check eligibility, deadline, payout and more

Kroger customers who used insurance to pay for prescriptions could be eligible for a share of a proposed $17 million class-action settlement over allegations that the grocery chain charged some customers more than they should have for generic drugs.

The lawsuit alleges Kroger did not account for lower prices offered through its Kroger Savings Club when calculating the “usual and customary” prices reported to insurers. Plaintiffs claim this resulted in some insured customers paying higher out-of-pocket costs.

Kroger denies the allegations and says Savings Club prices should not have been considered its standard prices because customers had to pay an annual membership fee and meet other requirements to receive the discounts. The company agreed to settle the case without admitting wrongdoing.


If the settlement receives final court approval, eligible customers who submit valid claims could receive a payment. Individual amounts will depend on the value of qualifying prescriptions and the total number of approved claims.

Who is eligible?

You may qualify if you:

• Paid all or part of the cost of one or more prescription drugs using insurance at a Kroger-owned or operated pharmacy.
• Filled the prescriptions between Dec. 9, 2018, and Aug. 23, 2026.

The settlement applies to eligible customers across the United States and its territories.

What is the lawsuit about?

Plaintiffs allege Kroger failed to include discounted Kroger Savings Club prices when determining the “usual and customary” prices it reported for certain generic prescription drugs.

According to the lawsuit, this led some insured customers to pay more than they would have if those lower prices had been considered.

The case includes claims of fraud, negligent misrepresentation and unjust enrichment. Kroger disputes the claims, arguing that Savings Club prices were available only to customers who enrolled in the program, paid an annual fee and met other requirements.

Kroger agreed to settle the lawsuit without admitting liability or wrongdoing.

How much money could you receive?

No estimated individual payment amount has been announced.

Payments will be distributed on a pro rata basis, meaning the amount each claimant receives will depend on:

• How much they paid, in whole or in part, for qualifying prescriptions during the settlement period.
• The total number and value of valid claims.
• The money remaining in the settlement fund after court-approved attorneys’ fees, litigation expenses and administrative costs are paid.

How can you file a claim?

Customers who received a settlement notice can submit a claim online using the Claim ID included in the notice.

Those who did not receive a notice but believe they qualify can also submit a claim through the settlement website.

Claimants must report or estimate how much they spent on qualifying prescriptions during the class period. Anyone claiming $8,000 or more must provide supporting documentation, while some people seeking smaller amounts may also be asked to verify their purchases.

Payments can be made by paper check, direct deposit, PayPal, Venmo or Zelle.

What is the deadline?

The deadline to file a claim is December 21, 2026.

Requests to exclude yourself from the settlement must be submitted by October 22, 2026.

A final approval hearing is scheduled for January 11, 2027. Payments will be made only if the settlement receives final court approval and any appeals are resolved.
