Jed York’s future with the San Francisco 49ers is under fresh scrutiny after the team owner entered a no contest plea to misdemeanor charges in Ohio, putting the spotlight on what the NFL could do next.

York, the longtime 49ers executive and owner, pleaded no contest to disorderly conduct and possessing criminal tools following his August 23 arrest in East Palestine, Ohio. He was initially arrested on suspicion of engaging in prostitution.

The legal development has now shifted attention from the Ohio courtroom to the NFL, which has its own rules governing the conduct of team owners.

Why Jed York is facing an NFL review

York’s plea gives the league a clear legal development to examine as it considers whether the incident violates its personal conduct policy.

The NFL has not announced disciplinary action against York. That means his immediate future with the 49ers remains unchanged, but the league review could still have consequences.

Possible outcomes could range from no disciplinary action to a suspension or other restrictions. A permanent loss of ownership would represent a much more serious step, although experts say such an outcome is far from certain based on the circumstances currently known.

Jodi Balsam, a professor of clinical law at Brooklyn Law School and former NFL counsel for operations and litigation, explained how these cases are typically handled.

“The typical framework in an incident that comes to the attention of the sports league that might implicate the personal conduct policy is, step one, investigation,” she said.

The NFL can conduct its own investigation even when a criminal case does not result in a conviction. In York’s case, the league could review police records, court documents and other evidence before determining whether disciplinary action is appropriate.

What happened to Jed York in Ohio?

According to court records, York was initially booked on charges of engaging in prostitution and possessing criminal tools after authorities investigated an alleged arrangement involving a woman and a payment of $140.

York later reached a plea deal with prosecutors.

He pleaded no contest to the lesser charge of disorderly conduct as well as possessing criminal tools. He was sentenced to one day in jail, received credit for time already served and was ordered to pay $1,150 in fines. His attorney also confirmed that York completed an online course.

The plea means the NFL now has a definitive court development to consider as part of its review.

Could Jed York lose ownership of the 49ers?

For now, there is no indication that York is being removed from the 49ers.

Robert Boland, a sports attorney and professor of sports management and sports law at New York University, emphasized that NFL owners are covered by the league’s personal conduct policy.

“Owners are under the personal conduct policy and can be suspended or potentially even separated from the league,” he told Inc.

However, that does not mean ownership loss is automatic.

The NFL would have to assess the facts and determine what punishment, if any, is appropriate. The league has previously treated cases involving owners differently depending on the circumstances and seriousness of the conduct.

Jed York’s role with the 49ers

York has been a central figure in the 49ers organization for years.

He became team president in 2008 and CEO of the organization in 2012. His family has owned the franchise since 1977, when it was purchased for $17 million.

York began his professional career as a financial analyst at Guggenheim Partners before joining the 49ers as director of strategic planning. He eventually rose to president and then CEO.

The team has also experienced considerable success during his tenure, winning NFC division championships in 2011, 2012, 2019, 2022 and 2023.

What happens next for Jed York?

The next major step is the NFL’s review.

One factor that could make the investigation less complicated is cooperation. Balsam noted that getting people to participate and provide truthful information can often be one of the biggest challenges for sports leagues investigating misconduct.

“Often, the biggest hurdle these leagues have is, how do you get people to cooperate and be forthcoming and be truthful,” she said. “That won’t necessarily be an issue here.”

For now, Jed York remains the principal owner of the San Francisco 49ers.

But his Ohio case has put his position under an unusual spotlight. The NFL’s eventual decision could determine whether the matter ends without significant league discipline or becomes a more serious issue for the 49ers owner.

The outcome could also attract attention across the league as the NFL determines how its personal conduct policy applies to one of its most powerful stakeholders.
