Washington is facing a growing security challenge from drones flying over military installations, public events and sensitive infrastructure, but federal officials still lack a single authority responsible for dealing with the threat.

The concern extends beyond hobbyist drones and accidental incursions. US counterintelligence officials are increasingly examining whether some suspicious flights could be connected to foreign intelligence operations, including activity linked to China.

Yet determining who is behind an individual drone flight can be extraordinarily difficult. According to CNN reporting, investigators often have little more than circumstantial evidence when trying to establish whether an operator is acting independently, on behalf of a foreign government or simply breaking aviation rules.


That uncertainty has made prosecutions difficult and exposed a broader weakness in America's counter-drone system.

Drone incursions expose gaps in US security

The problem has become known inside the national security community as counter-unmanned aircraft systems, or C-UAS.

Unlike conventional air threats, small drones can be inexpensive, commercially available and difficult to identify quickly. They can also appear over locations that fall under completely different federal, state or local jurisdictions.

One US official described the situation bluntly: because the threat affects so many agencies, responsibility can become unclear.

That problem became particularly visible in late 2023, when unidentified drones repeatedly appeared near a US Air Force installation in Virginia for 17 days.

CNN reported that the response became so disorganised that officials from the Joint Chiefs of Staff intervened to establish a task force, despite the body normally being responsible for military advice rather than operational command.

A former official involved in the episode described the situation as chaotic and embarrassing.

Military creates a coordinated response

The Virginia incident eventually prompted then-Defense Secretary Lloyd Austin to designate US Northern Command as the coordinating authority for small drone incidents involving military bases.

The arrangement has since produced a more structured response.

When an unidentified drone is reported over a military installation, officials can bring together representatives from the affected base, local police, the FBI, Department of Homeland Security and military services.

The aim is to determine quickly what equipment is available, who can deploy it and how the response should be organised.

According to officials familiar with the system, the process has improved coordination significantly.

But the military is only one part of the problem.

Counter-drone technology expands across government

Federal agencies are now investing heavily in technology designed to detect, track and disable unmanned aircraft.

The Pentagon established a dedicated effort to coordinate counter-drone capabilities across the military, while DHS created a similar office earlier this year.

Officials are examining technologies including directed-energy systems, lasers and high-powered microwaves that could potentially disable drones without the expense associated with traditional defensive systems.

The government is also expanding access to counter-drone training and equipment among state and local authorities.

That effort has become particularly important around large public gatherings, which officials regard as potential "soft targets."

The FBI has established temporary no-drone zones around major events and has increased surveillance for unauthorised flights.

CNN reported that during preparations surrounding this year's World Cup, federal authorities detected nearly 1,600 unauthorised drones and confiscated more than 700 by the week before the final.

Counter-drone operations have also gone wrong

Despite the push to improve security, recent incidents have demonstrated the risks of deploying new systems without sufficient coordination.

In February, the Federal Aviation Administration temporarily closed airspace over El Paso, Texas, after the Defense Department failed to coordinate properly with the aviation agency before allowing Customs and Border Protection to test a counter-drone laser.

The closure affected El Paso's airport for roughly eight hours.

Later that month, a US military laser system accidentally brought down a CBP-operated drone near the same region, according to CNN.

The incidents illustrate the complicated balance involved in defending against drones while ensuring that defensive systems themselves do not create new aviation hazards.

Private data centres present another vulnerability

One of the more difficult questions concerns critical infrastructure that is privately owned.

Federal authorities have clearer responsibilities when protecting military installations, but the situation becomes less straightforward when sensitive infrastructure belongs to private companies.

Officials have raised concerns about data centres that contain large quantities of government information while remaining outside direct military control.

In such cases, local police may effectively be the first line of defence, even when they lack sophisticated counter-drone equipment or the legal authority needed to use it.

That leaves a potentially significant gap between the sensitivity of the information being protected and the resources available to defend the physical facilities.

Why China is part of the counterintelligence debate

Chinese nationals and potential Chinese intelligence activity have emerged as another major focus for US investigators.

Officials believe some surveillance activity could involve civilian intermediaries rather than professional intelligence officers. Such individuals could potentially be pressured, encouraged or otherwise motivated to gather information about military facilities.

At the same time, former counterintelligence officials caution against automatically treating every suspicious drone flight involving a Chinese national as evidence of espionage.

CNN reported that US officials believe genuine Chinese intelligence flights may represent only a small proportion of the overall incidents.

China's intelligence system is also described as decentralised, creating another challenge for attribution. Individuals seeking information that could benefit Beijing may sometimes act independently rather than receiving a direct order from an intelligence agency.

Past case highlights difficulty of proving espionage

A 2024 incident involving a Chinese national illustrates the problem.

Federal authorities arrested Yinpiao Zhou after he was found to have operated a drone over Vandenberg Space Force Base during a military satellite launch.

Investigators discovered aerial photographs on his devices showing locations in several places, including parts of the United States and China.

Despite the suspicious circumstances, prosecutors ultimately secured a guilty plea for violating restricted airspace rules. A separate registration charge was dismissed under the plea agreement, and Zhou received a four-month federal sentence.

The case demonstrates the difference between suspect behaviour and evidence strong enough to establish an intelligence operation in court.

Officials fear what could happen next

Beyond espionage, US officials are concerned about the possibility of drones being used to deliver dangerous substances or weapons.

The theft of 15 agricultural pesticide drones in New Jersey was particularly alarming because of the possibility that such aircraft could be repurposed to carry chemical agents. Authorities eventually recovered the missing drones.

Officials are also conscious of the potential for a lone actor or terrorist group to exploit inexpensive drone technology against critical infrastructure or large civilian gatherings.

CNN reported that US officials familiar with current intelligence had found no indication of an active plot by Iranian proxy groups, ISIS or other terrorist organisations involving such attacks.

The concern, however, is that the technology creates an opportunity that could eventually be exploited.

White Sands offers a glimpse of what could work

A recent operation at White Sands was viewed by officials as an example of successful interagency coordination.

The operation demonstrated that different government agencies can combine surveillance capabilities and counter-drone resources when they have a common operating picture and a clearly organised response.

But officials involved in the broader effort caution that one successful operation does not resolve the underlying national security problem.

The United States is building new technology, expanding legal authorities and improving cooperation between agencies. Yet the central challenge remains: drones can cross jurisdictions faster than government agencies can determine who is responsible for stopping them.

For now, officials appear to agree on one point. The country is better prepared than it was several years ago, but significant vulnerabilities remain.
