The Calcutta High Court on Wednesday said it will decide on the admission of an appeal filed by the West Bengal government on the "inadequacy of sentence" by a trial court for convicted civic volunteer Sanjay Roy in the RG Kar Hospital rape-murder case, after hearing the central probe agency CBI, the victim's family and the convict. Meanwhile, the CBI on Wednesday filed an appeal before the Calcutta High Court, seeking death penalty for the convict. A bench of justice Debangshu Basak on Wednesday heard the argument over the "inadequacy of sentence" and whether the state can file a case on that issue. Admission of the appeal will be heard on January 27, people in the know said.

The state government had, on Tuesday, moved the high court seeking "death penalty" for Sanjay Roy, the sole convict in the rape-murder of a PG doctor at state-run RG Kar Medical College and Hospital. Chief minister Mamata Banerjee had expressed discontent over the verdict and announced that the state will appeal in HC.

The state's Advocate General Kishore Dutta said that the life sentence to the convict till the end of his natural life was inadequate. The Sealdah Court on Monday sentenced Sanjay Roy to life imprisonment till death in the case.

The 31-year-old postgraduate trainee doctor was raped and killed at RG Kar Hospital in Kolkata on August 9 last year. The victim's body was found in the seminar room of the hospital.
