Supreme Court of India

New Delhi: The Supreme Court on Wednesday hauled up Haryana Police for derailing investigation in the case of the rape of a four-year-old girl child in Gurugram.

A bench comprising CJI Surya Kant and justices Joymalya Bagchi and Vipul Pancholi came down heavily on the Haryana Police for attempting to dilute the gravity of the offence.

The bench observed that though there was prima facie evidence to indicate the offence of 'aggravated penetrative sexual assault' under Section 6 of the Protection of Children from Sexual Offences (POCSO) Act, the Haryana police chose to register the FIR only for 'aggravated sexual assault' under Section 10, a lesser offence.

The bench constituted a special investigation team to take over the probe.
