A bench of Chief Justice of India Surya Kant and justice Joymalya Bagchi said it was "not a justiciable issue". Rejecting the plea, the bench observed that the plea had become infructuous since the chadar offering had already been made.
The bench clarified that the order would not have any bearing on a civil suit pending before an Ajmer court concerning the Dargah.
A similar plea was earlier filed before the Ajmer court. That plea by Hindu Sena president Vishnu Gupta was part of an ongoing suit before the Ajmer court, alleging that the Ajmer Sharif Dargah was constructed on the site of a demolished Shiva temple. The plea argued that the central government, by sending a chadar to a "disputed structure", was undermining judicial independence and right to fair trial, when a case related to it was pending before the trial court.
