Supreme Court agrees to hear AAP mayor nominee plea on Delhi mayoral elections

Delhi Mayor elections: SC to hear AAP's plea seeking timely and early conduct of mayoral polls
The Supreme Court on Friday agreed to take up a plea filed by Aam Aadmi Party's mayoral candidate Shelly Oberoi seeking timely conduct of Delhi mayoral polls.

The petition was mentioned by senior advocate Abhishek Manu Singhvi before a bench of Chief Justice of India DY Chandrachud and justice Dipankar Datta.

Speaking for the bench, CJI Chandrachud said the plea would be listed on February 3. The mayoral election was stalled on Tuesday for the second time this month as the Municipal Corporation of Delhi House was adjourned indefinitely by the lieutenant governor-appointed presiding officer, following a ruckus by some councillors. The first meeting of the newly elected MCD House was also adjourned on January 6 owing to the ruckus between AAP and BJP members.


In her petition, Oberoi has also sought directions to restrain all the 10 nominated councillors from exercising their vote.

Oberoi has sought the election in a time-bound manner, as the same has been delayed for over a month despite AAP securing a majority in the MCD polls declared on December 7.

Citing several provisions of the Delhi Municipal Corporation Act, the petitioner has alleged that AAP is not being allowed to carry on with the functioning of the House. It argues that the election should be held as per law, which does not permit aldermen to cast vote.
