Supreme Court set to decide if states can levy extra sales tax


New Delhi: A seven-judge Supreme Court Constitution bench will start hearing on September 22 a key question: whether states have the power to impose an additional sales tax levy.

The three-decade-old issue assumes importance as the Odisha government amended the Orissa Sales Tax Act, 1947, and inserted Section 5A in 1997. The amendment allowed the state government to levy an additional tax of 10% on dealers with an annual turnover between ₹10 lakh and ₹1 crore and 15% on exceeding ₹1 crore.
